Welcome to Coastal Keepsakes.

Coastal Keepsakes is the trading name of Coastal Keepsakes Pty Ltd (ABN 65 702 048 922, ACN 702 048 922).

The terms “we”, “us” and “our” in these Terms of Service refer to Coastal Keepsakes Pty Ltd.

These Terms apply when you access our website, purchase a product or service from us, submit an order, or otherwise use our services.

Nothing in these Terms excludes, restricts or modifies any right or remedy that cannot lawfully be excluded, including rights under the Australian Consumer Law.

1. Our Products and Services

We provide personalised products, custom manufacturing, engraving, laser cutting, printing and related services.

Many of our products are individually manufactured for each customer rather than held as finished stock.

Product specifications, available materials, dimensions and personalisation options vary between products.

2. Product Images and Material Variations

We aim to represent our products accurately.

Reasonable differences in appearance may arise due to:

·       screen and monitor settings;

·       lighting;

·       photography;

·       material batches;

·       grain or texture;

·       manufacturing tolerances;

·       the inherent characteristics of materials.

Natural materials and manufactured decorative materials may contain minor variations between batches.

These provisions do not permit us to supply a product that is materially different from its description, approved design or applicable consumer guarantees.

3. Material Availability

We keep commonly used materials in stock but cannot hold every available colour, thickness, finish or sheet size.

Some materials may need to be ordered from a supplier. Special-order materials may add additional lead time to the normal production period.

If a material becomes unavailable or is likely to cause a significant delay, we will contact you to discuss reasonable alternatives or other available options.

4. Personalised Orders

You are responsible for checking information submitted with an order, including:

·       names;

·       dates;

·       spelling;

·       wording;

·       colours;

·       sizes;

·       quantities;

·       photographs;

·       artwork;

·       personalisation instructions.

We will generally manufacture a product using the information you provide.

Where a product has been manufactured correctly according to information supplied by you, an error in that supplied information does not ordinarily entitle you to a free replacement or refund.

This does not affect your Australian Consumer Law rights where the product itself fails to meet a consumer guarantee.

5. Design Proofs

Unless otherwise expressly stated, design work and proofs are generally provided after an order has been placed and paid for.

Production may be paused while we wait for information or design approval.

Where we provide a proof, you are responsible for checking the entire design before approving it.

Approval authorises us to manufacture the product substantially in accordance with that proof.

Reasonable revisions may be included depending on the product and scope of the order.

Significant changes to the original brief, additional concepts or extensive revisions may attract an additional design charge. We will advise you before carrying out work that will incur an additional charge.

6. Customer-Supplied Artwork and Content

If you provide photographs, logos, artwork, text, graphics, trademarks or other content, you confirm that you have the right or appropriate permission to provide that material to us and to authorise its reproduction for your order.

You authorise us to resize, crop, trace, convert, simplify or otherwise process supplied content where reasonably required to manufacture your order.

We may refuse to reproduce material where we reasonably believe doing so could:

·       infringe another person's rights;

·       breach applicable law;

·       contain unlawful material;

·       expose us to unreasonable legal risk.

Customer-supplied intellectual property remains the property of its owner.

7. Artwork Conversion

Artwork may need to be modified to make it suitable for engraving, printing, cutting or another manufacturing process.

This may include:

·       converting raster artwork to vectors;

·       simplifying detail;

·       adjusting line thicknesses;

·       converting colours;

·       removing unsuitable backgrounds;

·       adapting artwork to manufacturing limitations.

Some photographs and low-resolution artwork cannot be reproduced exactly as supplied.

Where a material change to the appearance of a supplied design is required, we will generally seek approval before production where reasonably practicable.

8. Customer-Supplied and BYO Items

We may agree to engrave, print or otherwise customise customer-supplied products.

Because these products are not manufactured or supplied by us, their exact materials, coatings, construction and manufacturing quality may not always be known.

We will take reasonable care when handling customer-supplied property.

To the extent permitted by law, we are not responsible for damage caused solely by:

·       pre-existing damage or defects;

·       defective or inconsistent factory coatings;

·       hidden layers or adhesives;

·       inaccurate manufacturer material specifications;

·       undisclosed repairs or modifications;

·       unexpected material reactions that could not reasonably have been identified beforehand;

·       an item's inherent unsuitability for the requested process.

If we believe an item is unsuitable or presents an unreasonable risk of damage, we may decline to process it.

Nothing in this section excludes liability arising from our failure to exercise due care and skill or any liability that cannot lawfully be excluded.

9. Orders

Submitting an order constitutes an offer to purchase the selected products or services.

An automated order acknowledgement does not prevent us from reviewing an order for manufacturing feasibility, availability or obvious errors.

We may reasonably decline or cancel an order where, for example:

·       a required material is unavailable;

·       the product cannot reasonably or safely be manufactured as requested;

·       there is an obvious pricing or listing error;

·       supplied material appears to infringe another person's rights;

·       the requested material is unlawful;

·       fraudulent activity is reasonably suspected;

·       circumstances outside our reasonable control prevent fulfilment.

If we cancel an order that has been paid and no goods or services have been supplied, we will refund the applicable amount.

Where work has already been completed, any refund or adjustment will be determined having regard to the circumstances, work performed and applicable law.

10. Changes and Cancellations

Custom work may commence shortly after an order is received.

If you need to change or cancel an order, contact us as soon as possible.

We may be unable to change or cancel an order after design work, material preparation or production has commenced.

Where a cancellation or alteration can reasonably be accommodated after work has commenced, reasonable costs already incurred may be payable, to the extent permitted by law.

We will advise you before carrying out additional work that would result in an additional charge.

11. Prices and GST

All consumer prices displayed on our Australian website are in Australian dollars (AUD) and include GST where applicable, unless clearly stated otherwise.

Coastal Keepsakes Pty Ltd is registered for GST.

Shipping costs and genuinely optional extras may be added where applicable. The applicable amount will be displayed before you complete your purchase.

Tax invoices will identify our ABN and GST information where required.

We may change prices for future purchases at any time.

Changes do not retrospectively alter an order already accepted by us, except where an obvious pricing error has occurred and applicable law permits the issue to be corrected.

12. Pricing and Listing Errors

Occasionally a website listing may contain an obvious error relating to a price, description, variant, quantity or configuration.

If an obvious error affects your order, we may contact you before fulfilment and explain the available options.

Depending on the circumstances, those options may include:

·       proceeding at the correct price with your agreement;

·       selecting an alternative product;

·       cancelling the affected product and receiving a refund.

We will not charge an additional amount without your agreement.

13. Payment

Payment must be made using an available payment method.

You must provide accurate payment and billing information.

For custom quotes, wholesale orders or other arrangements outside the normal online checkout, separate payment terms may be agreed in writing.

14. Production Time

Our usual production timeframe is approximately 3-5 business days, unless otherwise stated for a particular product or order.

Production periods are estimates rather than guaranteed completion dates.

Larger, bulk, technically complex or material-dependent orders may take longer.

Production may also depend on receiving:

·       complete personalisation details;

·       suitable artwork;

·       requested information;

·       design approval;

·       special-order materials.

If you have a fixed deadline, please contact us before ordering so that we can advise whether it is reasonably achievable.

15. Shipping

Shipping and delivery are governed by our Shipping Policy.

Carrier transit times are separate from our production time.

Selecting an express shipping service reduces the expected carrier transit time but does not automatically reduce the manufacturing time required for your order.

Delivery estimates are not guarantees unless we expressly agree otherwise.

Nothing in these Terms limits obligations that apply to us under Australian Consumer Law in relation to supplying goods within an agreed or reasonable time.

16. Local Pickup

Where available, free local pickup is offered from Buderim, Queensland.

We operate by appointment only.

Please do not attend for pickup until we have confirmed that your order is complete and provided collection arrangements.

17. Installation

Unless installation is expressly included in a written quotation or order, our products are supplied without installation services.

Where appropriate, products may be supplied with mounting holes, hardware or installation guidance as described in the relevant product listing or quotation.

18. Returns and Consumer Guarantees

Returns and refunds are governed by our Refund Policy and applicable Australian law.

Our products and services come with consumer guarantees that cannot be excluded under Australian Consumer Law.

Depending on the circumstances, you may be entitled to a repair, replacement, refund, re-supply of services or other remedy.

Nothing in these Terms is intended to exclude or restrict those rights.

19. Our Intellectual Property

Unless otherwise stated, our website content and original material, including:

·       branding;

·       logos;

·       photographs;

·       product photography;

·       graphics;

·       written content;

·       original product designs;

·       other creative material;

is owned by or licensed to Coastal Keepsakes Pty Ltd and is protected by applicable intellectual property laws.

You may use our website for ordinary personal shopping and informational purposes.

You must not reproduce, distribute, commercially exploit or represent our content as your own without permission or another lawful basis.

20. Custom Design and Production Files

Purchasing a physical customised product does not automatically transfer ownership of underlying production files created by us.

Unless otherwise agreed in writing, files such as:

·       vector artwork;

·       laser files;

·       print files;

·       manufacturing templates;

·       CNC files;

·       working design files;

remain our intellectual property.

This does not give us ownership of customer-supplied photographs, logos, trademarks or other pre-existing intellectual property.

21. Reviews and Customer Content

If you submit a review or other material through a feature intended for public display, you permit us to display that content for the purpose for which it was submitted.

We may moderate or remove unlawful, abusive, fraudulent or irrelevant content.

Supplying a photograph privately for manufacture of an order does not, by itself, grant permission for unrelated promotional use.

22. Third-Party Services

Our website and operations rely on third-party providers, including Shopify, payment processors and shipping carriers.

Those providers may have their own terms and privacy practices.

The involvement of a third-party provider does not remove obligations that Coastal Keepsakes Pty Ltd owes you under applicable Australian law.

23. Privacy

Personal information is handled in accordance with our Privacy Policy and applicable privacy laws.

24. Website Use

You must not use our website or services:

·       for an unlawful purpose;

·       to infringe another person's intellectual property rights;

·       to submit fraudulent information;

·       to interfere with website security or operation;

·       to transmit malware or harmful code;

·       to obtain unauthorised access to systems or information;

·       in another way that would cause us to breach applicable law.

We may take reasonable steps to protect our website, customers and systems from misuse.

25. Website Availability

We aim to keep our website accurate, secure and available.

However, online services may occasionally be unavailable due to maintenance, technical faults, third-party outages or circumstances outside our reasonable control.

Nothing in this section limits a right or remedy that cannot lawfully be excluded.

26. Liability

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, statutory right or liability that cannot lawfully be excluded, restricted or modified.

To the extent permitted by law, we are not responsible for loss caused solely by:

·       misuse of a product;

·       failure to follow reasonable instructions;

·       inaccurate information supplied by the customer;

·       events genuinely outside our reasonable control.

Any limitation in these Terms applies only to the maximum extent permitted by applicable law.

27. Events Outside Our Reasonable Control

Events outside our reasonable control may occasionally delay production or delivery.

Examples include:

·       severe weather;

·       natural disasters;

·       widespread power or telecommunications outages;

·       significant carrier disruption;

·       government restrictions;

·       major supplier disruption;

·       other comparable events.

If such an event materially affects an order, we will take reasonable steps to minimise its impact and communicate with affected customers where appropriate.

Nothing in this section limits your statutory rights.

28. Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision will be interpreted or severed only to the extent necessary. The remaining provisions will continue to operate.

29. No Waiver

If we do not immediately enforce a provision of these Terms, this does not mean that we waive our right to enforce it later.

30. Changes to These Terms

We may update these Terms from time to time.

The version applying to an order will generally be the version in effect when the order was placed, unless applicable law requires otherwise or you agree to a change.

The current version will be published on our website.

31. Governing Law

These Terms are governed by the laws of Queensland, Australia, together with applicable Commonwealth laws.

Nothing in this provision prevents a consumer from exercising rights available under applicable law in another Australian jurisdiction.
