TERMS OF SERVICE

Welcome to Coastal Keepsakes.
The terms “we”, “us” and “our” refer to Coastal Keepsakes. We operate this website and online store using Shopify and provide personalised products, custom manufacturing, engraving, printing and related services.
By accessing our website, placing an order or otherwise using our services, you agree to these Terms of Service together with our Privacy Policy, Refund Policy and Shipping Policy.
Nothing in these Terms excludes, restricts or modifies any rights or remedies that cannot lawfully be excluded under the Australian Consumer Law or other applicable law.
SECTION 1 – USING OUR WEBSITE
You must use our website and services only for lawful purposes.
You must not:

use the website in a way that breaches any applicable law;

attempt to gain unauthorised access to our systems;
-
introduce malicious code, viruses or other harmful material;
-
interfere with the operation or security of the website;
-
use our content or services to infringe another person's rights; or
-
provide false, misleading or fraudulent information.
If you create an account, you are responsible for keeping your login information secure and for ensuring the information associated with your account remains accurate.
SECTION 2 – PRODUCTS AND PRODUCT IMAGES
We make reasonable efforts to accurately display and describe our products.
Because many of our products are handmade, personalised or manufactured from materials including timber, acrylic, metal, slate and other substrates, minor variations may occur between individual products.
Natural materials may contain variations in grain, colour, texture, markings and finish. These characteristics are not necessarily defects.
Colours displayed on a screen may also vary from the physical material due to differences in monitors, devices, lighting, photography and manufacturing batches.
Product photographs, renders and mock-ups are intended to represent the product as accurately as reasonably possible but should not be regarded as a guarantee of an exact colour or appearance.
SECTION 3 – ACRYLIC AND MATERIAL AVAILABILITY
We keep a range of commonly used acrylic colours and materials in stock, but it is not practical for us to hold every available colour, thickness and sheet size.
If a required material is not currently in stock, we may need to order it from one of our suppliers.
Supplier deliveries typically take approximately 5 business days, although this is an estimate and may vary due to supplier availability, freight delays or other circumstances outside our reasonable control.
This supplier lead time is additional to our usual production timeframe, which is currently approximately 2–4 business days.
If a selected material becomes unavailable or is likely to cause a significant delay, we will contact you to discuss suitable alternatives or other available options.
SECTION 4 – CUSTOM AND PERSONALISED ORDERS
Customers are responsible for ensuring that all information submitted with an order is correct, including:

names;
-
dates;
-
spelling;
-
wording;
-
sizes;
-
colours;
-
quantities; and
-
other personalisation instructions.
Please review all information carefully before submitting your order.
Where we provide a design proof, you are responsible for checking the entire proof before approving it.
Once a design has been approved, we will generally manufacture the item according to that approved design.
If an item has been produced correctly according to information supplied by you or a proof approved by you, we are generally unable to provide a free replacement or refund solely because an error was contained in that supplied or approved information.
This does not affect your rights where the product itself fails to meet a consumer guarantee under Australian Consumer Law.
SECTION 5 – DESIGN PROOFS
Unless otherwise stated for a particular product, design work and proofs are generally provided after an order has been placed and paid for.
The number and extent of revisions included may depend on the product and complexity of the design.
Significant changes to the original brief, additional concepts or extensive revisions may incur an additional design fee. We will advise you before proceeding with any work that would incur an additional charge.
Production may not commence until any required proof has been approved.
Delays in providing requested information or approving a proof may affect the completion and delivery timeframe.
SECTION 6 – CUSTOMER-SUPPLIED ARTWORK AND CONTENT
If you provide us with photographs, logos, artwork, text, graphics, trademarks or other material for use in your order, you confirm that you own that material or have permission to use and reproduce it for the requested purpose.
You grant us permission to reproduce, modify, resize, convert or otherwise process that material as reasonably necessary to produce your order.
We may refuse to reproduce material where we reasonably believe doing so may:
-
infringe another person's intellectual property rights;
-
breach applicable law;
-
contain unlawful material; or
-
otherwise expose us to legal liability.
You remain responsible for obtaining any permissions or licences required for material you supply to us.
SECTION 7 – ARTWORK CONVERSION
Artwork supplied by customers may need to be modified or converted to make it suitable for laser engraving, cutting, printing or another manufacturing process.
This may include simplifying artwork, converting colours, adjusting line thicknesses, tracing graphics or converting raster images to vector artwork.
Certain images or low-quality artwork may not reproduce exactly as supplied.
Where the appearance of the finished design may differ materially from the original artwork, we will generally provide a proof for approval before production.
Additional artwork or design charges may apply where significant artwork preparation is required. We will advise you of any additional charge before proceeding.
SECTION 8 – CUSTOMER-SUPPLIED ITEMS AND BYO ENGRAVING
We offer engraving and other customisation services on some customer-supplied items.
Customer-supplied products can vary considerably in material, coating, construction and manufacturing quality. Some characteristics may not be apparent until engraving or processing begins.
We will take reasonable care when handling and processing customer-supplied property.
However, to the extent permitted by law, we are not responsible for problems caused by:
-
pre-existing defects or damage;
-
inconsistent or defective factory coatings;
-
inaccurate manufacturer material specifications;
-
hidden layers, adhesives or coatings;
-
material reactions that could not reasonably have been identified beforehand; or
-
an item's inherent unsuitability for the requested manufacturing process.
If we believe an item is unsuitable or presents an unreasonable risk of damage, we may decline to process it.
Nothing in this section excludes liability that cannot lawfully be excluded.
SECTION 9 – ORDERS
Submitting an order constitutes an offer to purchase the selected products or services.
An order is accepted when we accept payment and begin processing the order, subject to availability and any additional information or approval required from you.
We may decline or cancel an order where reasonably necessary, including where:
-
a product or material is unavailable;
-
there is an obvious pricing or listing error;
-
we cannot safely or reasonably manufacture the requested product;
-
supplied material may infringe another person's rights;
-
the order involves unlawful material;
-
we reasonably suspect fraudulent activity; or
-
circumstances outside our reasonable control prevent us from fulfilling the order.
If we cancel an order that has been paid for and no goods or services have been supplied, we will refund the applicable amount paid.
SECTION 10 – ORDER CHANGES AND CANCELLATIONS
Because many of our products are custom-made, work may begin shortly after an order is received.
If you wish to change or cancel an order, contact us as soon as possible.
We may be unable to cancel or change an order once design work, material preparation, customisation or production has commenced.
Where a requested change can still be accommodated, additional design, material or production charges may apply. We will advise you of any additional cost before proceeding.
Our Refund Policy provides further information regarding cancellations, returns and refunds.
SECTION 11 – PRICES AND PAYMENT
All prices displayed on our Australian website are in Australian dollars (AUD) unless otherwise stated.
Displayed prices include any applicable taxes that are required to be included in the advertised price.
Delivery charges and optional extras may be added during checkout where applicable and will be displayed before you complete your purchase.
We may change our prices at any time. Price changes do not retrospectively alter the price of an order that we have already accepted, except where an obvious pricing error has occurred and the law permits us to correct it.
You agree to provide accurate and current payment and billing information.
SECTION 12 – PRICING AND LISTING ERRORS
Occasionally a product may contain an obvious error relating to its price, description, availability, variant or configuration.
Where an obvious error has occurred, we may contact you before fulfilling the order to explain the issue and provide available options.
Depending on the circumstances, those options may include:
-
proceeding at the correct price with your agreement;
-
selecting an alternative product; or
-
cancelling the affected item and providing a refund.
We will not charge an additional amount without your agreement.
SECTION 13 – PRODUCTION TIMEFRAMES
Our normal production timeframe is approximately 2–4 business days, unless otherwise stated.
Production timeframes are estimates rather than guaranteed completion dates.
Larger, more complex, bulk or material-dependent orders may require additional time.
Production time may also depend on receiving:
-
complete personalisation details;
-
suitable artwork;
-
requested information;
-
design approval; or
-
special-order materials.
If you have a firm deadline, please contact us before ordering so we can confirm whether the timeframe is reasonably achievable.
SECTION 14 – SHIPPING AND DELIVERY
Shipping is governed by our Shipping Policy.
Delivery dates and carrier transit times are estimates and may be affected by circumstances outside our reasonable control.
Selecting Express Post or an express courier service reduces the expected carrier transit time but does not automatically reduce our production time.
We remain responsible for complying with our obligations under Australian Consumer Law, including where goods are not supplied as required by law.
If a shipment is delayed, lost or damaged, please contact us so we can assist with the carrier enquiry and determine the appropriate next steps.
SECTION 15 – LOCAL PICKUP
Where offered at checkout, free local pickup is available from Buderim, Queensland.
We operate by appointment only.
Please do not attend for collection until you have received confirmation that your order is ready and collection arrangements have been provided.
SECTION 16 – REFUNDS, RETURNS AND CONSUMER GUARANTEES
Returns, refunds and cancellations are governed by our Refund Policy and applicable Australian law.
Our products come with guarantees that cannot be excluded under the Australian Consumer Law.
Depending on the circumstances, you may be entitled to a repair, replacement, refund or other remedy where a product or service fails to meet an applicable consumer guarantee.
Nothing in these Terms is intended to exclude, restrict or modify those rights.
SECTION 17 – INTELLECTUAL PROPERTY
Unless otherwise stated, the content of our website, including our:
-
branding;
-
logos;
-
photographs;
-
product photography;
-
product descriptions;
-
graphics;
-
website content;
-
original designs; and
-
other creative material
is owned by or licensed to Coastal Keepsakes and is protected by applicable intellectual property laws.
You may view and use our website for personal shopping and informational purposes.
You must not reproduce, copy, distribute, sell or commercially exploit our website content without our permission or another lawful basis for doing so.
Customer-supplied artwork remains the property of its respective owner.
SECTION 18 – CUSTOM DESIGN WORK
Purchasing a physical custom product does not automatically transfer ownership of any underlying digital design file, production file, vector artwork, template, laser file, print file or other manufacturing artwork created by Coastal Keepsakes.
Unless we expressly agree otherwise, these production files remain our intellectual property.
This does not give us ownership of customer-supplied logos, photographs, trademarks or other pre-existing intellectual property.
SECTION 19 – THIRD-PARTY SERVICES
Our website may use services provided by third parties, including Shopify, payment providers, shipping carriers and other service providers.
Your use of some third-party services may also be subject to their respective terms and privacy policies.
Coastal Keepsakes remains responsible for its own obligations to you under applicable Australian law.
SECTION 20 – THIRD-PARTY LINKS
Our website may contain links to websites operated by third parties.
We do not control those websites and are not responsible for their availability, content or privacy practices.
Accessing a third-party website is at your discretion and may be subject to that website's own terms and policies.
SECTION 21 – SHOPIFY
Our online store is hosted using Shopify.
Shopify provides the ecommerce platform that enables us to offer products and services online, but your purchase of Coastal Keepsakes products is made from Coastal Keepsakes.
Our relationship with you remains subject to these Terms and applicable Australian law.
SECTION 22 – PRIVACY
We collect, use and handle personal information in accordance with our Privacy Policy and applicable privacy laws.
Third-party providers used to operate our store may also process information in accordance with their own privacy policies.
SECTION 23 – REVIEWS, PHOTOS AND CUSTOMER CONTENT
If you submit a review, photograph or other content through a feature intended for public display, you give us permission to display that content for the purpose for which it was submitted.
If we wish to use customer-provided photographs or other content for a substantially different promotional purpose, we may seek permission where appropriate.
You confirm that content you submit does not unlawfully infringe the rights of another person.
SECTION 24 – PROHIBITED USES
You must not use our website or services:

for unlawful purposes;
-
to infringe intellectual property or other rights;

to submit fraudulent information;
-
to harass, abuse or harm another person;
-
to transmit malware or harmful code;
-
to collect information about other users without lawful authority;

to interfere with website security or functionality; or
-
in any way that would cause us to breach applicable law.
We may restrict access to our services where reasonably necessary to protect our business, customers, systems or legal rights.
SECTION 25 – WEBSITE AVAILABILITY
We aim to keep our website accurate, secure and available, but we cannot guarantee that online services will always operate uninterrupted or without technical errors.
We may temporarily suspend or modify website functionality for maintenance, security, technical or operational reasons.
Nothing in this section limits any consumer guarantee or other right that cannot lawfully be excluded.
SECTION 26 – LIMITATION OF LIABILITY
Nothing in these Terms excludes, restricts or modifies any guarantee, right, remedy or liability that cannot legally be excluded, restricted or modified under Australian Consumer Law or other applicable law.
To the extent permitted by law, Coastal Keepsakes is not responsible for losses caused solely by circumstances outside our reasonable control or by a customer's misuse of a product.
Any limitation of liability in these Terms applies only to the maximum extent permitted by law.
SECTION 27 – CUSTOMER-SUPPLIED MATERIAL AND THIRD-PARTY CLAIMS
You are responsible for ensuring you have the necessary rights and permissions for artwork, logos, photographs, text or other content you instruct us to reproduce.
To the extent permitted by law, you are responsible for reasonably foreseeable loss suffered by us as a direct result of a third-party claim arising from material you supplied where you did not have the necessary right or permission to use that material.
This section does not apply to the extent that the loss was caused or contributed to by our own act, omission or breach of law.
SECTION 28 – EVENTS OUTSIDE OUR CONTROL
We will not be responsible for delay caused by events genuinely outside our reasonable control, such as:
-
severe weather;
-
natural disasters;
-
major carrier disruptions;
-
widespread telecommunications or power outages;
-
government restrictions; or
-
significant supplier disruptions.
If such an event materially affects our ability to fulfil an order, we will take reasonable steps to minimise the impact and contact affected customers where appropriate.
Nothing in this section limits rights available under Australian Consumer Law.
SECTION 29 – SEVERABILITY
If any provision of these Terms is found to be invalid or unenforceable, that provision will be interpreted or severed to the extent necessary, and the remaining provisions will continue to operate.
SECTION 30 – NO WAIVER
If we do not immediately enforce a provision of these Terms, that does not mean we waive our right to enforce it later.
SECTION 31 – ENTIRE AGREEMENT
These Terms, together with our applicable policies and the information provided in relation to your particular order, form the agreement between you and Coastal Keepsakes concerning your use of our services and purchase.
Nothing in this section excludes representations or rights that cannot lawfully be excluded.
SECTION 32 – CHANGES TO THESE TERMS
We may update these Terms from time to time.
The version applying to an order will generally be the version in effect when that order was placed, unless a change is required by law or you agree otherwise.
The current version will be published on our website with its updated effective date.
SECTION 33 – GOVERNING LAW
These Terms are governed by the laws of Queensland, Australia, and applicable Commonwealth laws.
Nothing in this section restricts any right you may have to bring a claim or exercise a remedy in another jurisdiction where applicable law gives you that right.
